Yes- Penguin Can be a cop. He can be both a scum cop or a town cop- the rules allow that. He can also have any of the modifiers listed in the wiki page.

HE CANNOT be an N-0 cop without the rest of the players knowing that N-0 was a thing or even took place.
That's just unfair/BS/garbage/ridiculous/cheating/unbalanced/against-the-rules
