I don't get why thats the rules. Every time i have played this game you don't need a majority you just need one guy with the most votes. but whatever I guess it technically helps us out.

They can look that way. Someone who was hopelessly confused early on in my last game turned out to be scum flying under the radar the whole time. It could go both ways as being confused happens regardless of alignment.
