LucianRoy is confirmed to have the ability to kill during the day (did any of us doubt that?) - but I don't see that as being confirmed town at all.
Heck he could even be Berlin City mafia, he really had no choice but to use it that way. He was wanting to use it yesterday when we had no information.
I'm not saying he's probably not town or anything, just it doesn't confirm anything other than he can kill during that day.
